Wo property jiska ownership registry se nahi, balki Power of Attorney document ke through transfer hua ho.
What are the types of Power of Attorney (PoA)?
Power of Attorney ko alag-alag types mein divide kiya ja sakta hai. Yaani, kisi person ko kitna power diya gaya hai — uss basis par PoA ke yeh main types hote hain:
General Power of Attorney (GPA)
Isme ek person (principal) dusre person (agent) ko broad powers deta hai.
Wo uski taraf se multiple kaam kar sakta hai, jaise:
- Property bechna ya kharidna
- Rent lena ya dena
- Bank transactions karna
- Property manage karna
- Court case handle karna, etc.
GPA mostly tab diya jata hai jab koi NRI ho, ya kisi ko time nahi ho kaam karne ka.
Special Power of Attorney (SPA)
SPA mein sirf specific kaam karne ka right diya jata hai.
Jaise:
- Sirf ek property bechne ka
- Sirf loan ke documents sign karne ka
- Sirf rent agreement renew karne ka
SPA ka scope limited hota hai. Agent koi extra kaam nahi kar sakta jise document mein clearly mention nahi kiya gaya ho.
Durable Power of Attorney
Yeh PoA tab tak valid rehta hai jab tak agent zinda ho — even if the person who gave PoA becomes mentally unfit.
Yeh mostly medical cases, old age ya NRI situations mein diya jata hai.
Revocable & Irrevocable Power of Attorney
- Revocable PoA: Jise kabhi bhi cancel (revoke) kiya ja sakta hai
- Irrevocable PoA: Jise cancel nahi kiya ja sakta, unless court ya agreement allow kare
